Wedding & Event Photography Agreement
Thank you for reserving my photography services for your wedding or special event.
This agreement ensures clear communication and a positive experience for all parties. Please print or screenshot this page for your records.
Booking & Payment
A non-refundable deposit equal to 50% of the anticipated Coverage or Complete Collection value is required to reserve Dana Siles Photographer (the “Photographer”) for the wedding or event (the “Date”). The remaining balance is due three weeks prior to the Date.
If payments are not received when due, the Photographer may suspend performance under this Agreement, and no images, products, usage rights, or other deliverables will be released until payment has been received in full. If the Date changes, the Photographer may retain the deposit. If available for the new Date, an additional equal non-refundable deposit is required.
Services & Deliverables
If unforeseen circumstances prevent the Photographer from attending, she will make reasonable efforts to provide a comparable photographer at no additional cost. All conditions and fees of this agreement will apply. If no replacement is available, prior payments will be refunded.
The Client acknowledges that the Photographer's work is artistic in nature. The Photographer reserves the right to select, edit, and deliver images at her sole artistic discretion. The Photographer will use all reasonable efforts to provide services in a professional manner consistent with industry standards. The Client agrees to indemnify and hold the Photographer harmless from any third-party claims arising from the Client's use of the images or services.
Products resulting from Coverage and Complete Collections include:
Early Preview: A minimum of 10 fully edited images selected by the Photographer delivered electronically within five business days of the event.
Gallery Premiere: The complete online gallery of high-resolution JPG files will be delivered within 2–6 weeks of the event. Files are downloadable and shareable; the gallery includes one set of Dana’s Selects to help guide final image selections.
Signature Glass Box Prints: If included in the chosen Coverage or Complete Collection, printed photographs selected by the Photographer and presented in Dana’s signature glass box, delivered within 2–6 weeks of the event.
Acrylic Floating Frame: If included in the chosen Coverage or Complete Collection, a fully assembled Acrylic Floating Frame featuring two photographs selected by the Photographer, delivered within 2–6 weeks of the event.
Prints, Albums & Ordering: Unless included in the selected Coverage or Complete Collection, prints are paid in full at the time of ordering, and albums require a 50% deposit with the full balance due before delivery. Production timelines are 2–8 weeks for prints and 2–6 months for albums. All delivery timelines are estimates and may be subject to delays beyond the Photographer’s control.
Copyright & Usage
All negatives, RAW files, and original image files remain the exclusive property of the Photographer. The Photographer retains all copyrights and other intellectual property rights to all images created under this Agreement.
Clients who receive high-resolution JPG files are granted a non-exclusive, non-transferable license to reproduce, print, share, and display images for personal, non-commercial use only. Delivery of high-resolution files does not transfer copyright or ownership rights.
Images may not be sold, licensed, submitted for publication, used in advertising, entered into contests, or otherwise used for commercial purposes without the Photographer’s prior written consent.
The Photographer retains the right to use images created under this Agreement for portfolio, editorial, exhibition, website, social media, advertising, and other promotional purposes unless otherwise agreed in writing.
AI Usage Restriction
Clients may use personal editing tools for non-commercial purposes; however, images created under this Agreement may not be uploaded, submitted, licensed, or otherwise provided to any artificial intelligence (AI) system, machine learning platform, or similar or successor technology, whether now known or later developed, for training, dataset inclusion, model development, facial recognition, synthetic image generation, stylistic replication, or the creation of derivative works, whether in whole or in part, including through third-party services incorporating AI functionality, without the Photographer’s prior written consent.
Additional Terms
Failure to perform or delay in performance due to circumstances beyond the Photographer’s reasonable control, including but not limited to illness, injury, acts of God, weather, or travel disruption, shall not constitute a breach of this Agreement. In such circumstances, the Photographer’s liability shall be limited to the return of payments received or a rescheduled session if mutually agreed upon.
The Photographer requires a hot vegetarian meal served at the same time as the guests’ main course for events lasting four hours or longer.
Travel beyond 90 miles of Providence, RI or 60 miles from Armonk, NY (on select dates) may require accommodations and/or a mileage fee of $1 per mile.
Rhode Island Sales Tax (7%) applies to all purchases. Payment is accepted via personal or business check, PayPal (4% processing fee), or wire transfer ($15 fee). Returned checks incur a $25 fee.
Prices quoted for services, albums, prints, retouching, and other products remain valid for up to six months following the shoot date. After six months, all pricing is subject to change.
Governing Law & Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Rhode Island. Any dispute arising under or relating to this Agreement shall be brought exclusively in the state or federal courts located in Rhode Island, and the parties consent to the jurisdiction of such courts.
After accepting the agreement, you’ll be directed to submit your 50% deposit. Dana will then reach out personally to discuss next steps.
