Professional Event Photography Agreement

Thank you for reserving my photography services for your professional event.

This agreement ensures clear communication and a positive experience for all parties. Please print or screenshot this page for your records.

This Agreement is entered into between Dana Siles (“Photographer”) and the Client (“Client”). Client retains Photographer to create and deliver photographic images (the “Photographs”).

A. Booking & Payment

A non-refundable 50% deposit is required to reserve Dana Siles Photographer (“Photographer”) for the event date (the “Date”). The remaining balance is due on the day of the event. If a second shooter is required, an additional $500 non-refundable deposit applies. Deposits are transferable.

No rights are granted until payment is received in full. If payment is not received as scheduled, Photographer may be released from all obligations under this Agreement, and all deliverables will be withheld until payment is made in full. Unauthorized use of the Photographs prior to full payment constitutes copyright infringement under the United States Copyright Act.

If the Date changes, Photographer may retain the original deposit. If Photographer is available for a rescheduled date, an additional non-refundable deposit equal to the original deposit will be required to secure the new date.

B. Services

Photographer’s services are personal and unique and may not be assigned, transferred, or subcontracted without Client’s prior written consent.

In the event Photographer is unable to attend due to unforeseen circumstances, she will make reasonable efforts to secure a comparable replacement photographer at no additional cost. All terms and conditions of this Agreement shall remain in effect. If no suitable replacement is available, all payments made will be refunded.

Photographer will perform services in a professional manner consistent with industry standards. Client agrees to indemnify and hold Photographer harmless from any third-party claims arising from the services provided.

C. Deliverables

Products resulting from coverage include:

A curated online gallery of lightly edited proofs, bearing a medium “Proof” watermark, delivered within 3–16 days following the event.
Selects: fully edited images, with subtle retouching as needed, delivered within 2–5 days after selections are made.

D. Copyright, Usage & Credit

Client is granted usage rights as outlined in this Agreement. Any usage beyond this scope requires prior written approval and may be subject to additional licensing fees. Photographs may not be shared, distributed, or licensed to third parties without Photographer’s prior written consent.

Client grants Photographer permission to use the Photographs for portfolio, marketing, and promotional purposes, including but not limited to website, print, display, and social media.

E. Warranties & Liability

Photographer warrants that the Photographs were created by her and that she has the authority to license their use to Client.

Unless otherwise agreed in writing, no model or property releases are included. Client is solely responsible for obtaining any necessary releases and assumes all liability for the use of the Photographs.

Client agrees to indemnify and hold Photographer harmless from any and all claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from the use or misuse of the Photographs.

Photographer shall not be liable for any injury, accident, loss, or damage to persons or property in connection with the event or services provided, except in cases of gross negligence or willful misconduct. Client is responsible for maintaining a safe environment for all attendees, staff, and vendors.

Client agrees to be responsible for all reasonable costs incurred by Photographer in enforcing this Agreement, including attorneys’ fees, whether or not legal action is initiated.

F. Governing Law

This Agreement shall be governed by the laws of the state of Photographer’s residence. Client consents to personal jurisdiction and venue in that state.

Additional Terms

Travel beyond 90 miles of Providence, RI (or 60 miles from Armonk, NY on select dates) may require accommodations and/or a mileage fee of $1 per mile.

Rhode Island sales tax (7%) applies to all purchases except those made by registered 501(c)(3) nonprofit organizations. Payment is accepted via personal or business check, PayPal (4% processing fee), or wire transfer ($15 fee). Returned checks incur a $25 fee.

Prices quoted for services, albums, negatives, and prints remain valid for six months following the event date. After six months, all pricing is subject to change.

After accepting the agreement, you’ll be directed to submit your 50% deposit. Dana will then reach out personally to discuss next steps.
